By creating an account or using CreateMySocialAI, you agree to these Terms of Service. Please read them carefully. If you do not agree to these Terms, do not use the Service.
These Terms of Service ("Terms") govern your use of the CreateMySocialAI platform ("Service") operated by KJONGSys LLC, doing business as CreateMySocialAI ("CreateMySocialAI," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for activity occurring through your account.
You must notify us promptly if you become aware of unauthorized access to your account.
You may not share account credentials with unauthorized users or create accounts for automated use except through functionality expressly provided or authorized by CreateMySocialAI.
You must be at least 18 years old to use the Service.
Paid plans may include a free trial where offered. The duration and terms of any trial will be disclosed when you subscribe.
Unless otherwise stated during enrollment, your paid subscription begins after the trial period and continues at the selected plan rate until canceled.
Subscriptions are generally billed monthly in advance unless another billing period is stated when you subscribe.
Prices are stated in U.S. dollars and do not include applicable taxes unless expressly stated otherwise.
You may upgrade or downgrade your subscription subject to the options available through your account. Upgrades may take effect immediately and may result in prorated charges. Downgrades generally take effect at the beginning of the next billing period.
You may cancel your subscription through the billing portal or other cancellation method provided through your account.
Unless otherwise stated, access continues through the end of the current paid billing period. We do not provide prorated refunds for unused portions of a billing period except as required by law or expressly provided in our Refund Policy.
You agree not to use the Service to:
We may suspend, restrict, or terminate access when reasonably necessary to enforce these Terms, protect the Service or its users, comply with law, or comply with requirements imposed by a connected third-party platform.
You retain your ownership rights in content that you upload or provide to CreateMySocialAI.
You grant CreateMySocialAI a nonexclusive, limited license to host, store, process, reproduce, modify, transmit, and publish your content as reasonably necessary to provide the Service and perform actions you authorize.
You are responsible for ensuring that you have the rights and permissions necessary for content you provide or authorize for publication.
CreateMySocialAI uses artificial intelligence and automated systems to generate proposed social media content based on information associated with your account, business profile, preferences, campaigns, and other information you provide.
AI-generated content may contain errors, omissions, unsuitable wording, inaccurate information, or other unexpected results.
Certain CreateMySocialAI features may allow content to be generated, scheduled, and published automatically to connected social media accounts without your reviewing or approving each individual post before publication.
By intentionally enabling an Auto-Pilot feature for a supported social media platform, you authorize CreateMySocialAI to generate, schedule, and publish content to that connected account in accordance with the settings and permissions you select.
You remain responsible for monitoring your connected accounts and configuring the Service appropriately for your business.
Not every connected social media platform permits the same level of automation.
A platform may require you to review, select, approve, confirm, or otherwise take action concerning individual content before CreateMySocialAI may publish it.
When such a requirement applies, CreateMySocialAI may place generated content into a pending approval state instead of publishing it automatically.
For Pinterest, generated Pins may require your affirmative selection or approval before they become eligible for scheduled publication.
Approval of one Pin does not constitute approval of different future Pins unless permitted by Pinterest's applicable policies.
Once you approve a particular Pin for scheduled publication, CreateMySocialAI may publish that approved Pin automatically at the scheduled time without requiring you to return at the time of publication.
If content requiring individual approval is materially changed after you approve it, CreateMySocialAI may require the revised content to be approved again before publication.
CreateMySocialAI integrates with third-party platforms that may include Meta services such as Facebook and Instagram, Pinterest, LinkedIn, X, and other services.
When you connect a third-party account, you authorize CreateMySocialAI to access that account and perform permitted actions within the scope of the permissions you grant.
Your use of a connected account remains subject to the applicable platform's own terms, policies, developer rules, API restrictions, and technical requirements.
Third-party platforms may change their APIs, policies, permissions, approval requirements, rate limits, or available functionality at any time.
As a result, CreateMySocialAI may add, modify, restrict, temporarily disable, or discontinue platform-specific functionality when reasonably necessary to:
CreateMySocialAI does not control third-party platforms and cannot guarantee that any particular integration or feature will remain available.
We are not responsible for actions independently taken by a third-party platform, including suspension, restriction, removal of content, changes to API access, or changes to account functionality, except to the extent otherwise required by applicable law.
When you connect a social media account and grant permissions through that platform's authorization process, you authorize CreateMySocialAI to use those permissions solely to provide the features you request.
Depending on the platform and features you enable, authorized actions may include:
Authorization to connect an account does not override platform-specific requirements that require additional approval for a particular action.
You may revoke CreateMySocialAI's access through available account controls or through the applicable third-party platform.
We work to maintain reliable availability but do not guarantee uninterrupted access.
The Service may occasionally be unavailable because of maintenance, software updates, third-party service interruptions, social platform API changes, outages, security issues, or circumstances outside our control.
To the maximum extent permitted by law, we are not liable for losses resulting solely from temporary service interruptions or third-party platform outages.
To the maximum extent permitted by applicable law, CreateMySocialAI and KJONGSys LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of business opportunity, or loss of data, arising from or relating to the Service.
To the maximum extent permitted by law, our aggregate liability for claims arising from or relating to the Service or these Terms will not exceed the amount you paid to CreateMySocialAI during the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

You are responsible for determining whether generated content and enabled automation settings are appropriate for your business.
To the extent permitted by law, you agree to indemnify and hold harmless KJONGSys LLC, CreateMySocialAI, and their officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:
This provision does not require you to indemnify us for claims resulting solely from our own unlawful conduct where such indemnification is prohibited by law.
You may discontinue use of the Service or cancel your subscription as provided in these Terms.
We may suspend, restrict, or terminate access if you violate these Terms, create security or legal risk, misuse a third-party integration, or if suspension is reasonably necessary to comply with applicable law or third-party platform requirements.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination, including provisions concerning intellectual property, limitation of liability, indemnification, disputes, and governing law, will survive.
We may modify these Terms from time to time.
We will provide notice of material changes at least 14 days before they become effective by email, in-app notice, or another reasonable method.
Continued use of the Service after the effective date of revised Terms constitutes acceptance of those revised Terms to the extent permitted by law.
Third-party platform changes may occasionally require us to modify platform-specific functionality more quickly than this notice period allows.
These Terms are governed by applicable United States law and the law of the state identified as governing law for KJONGSys LLC, without regard to conflict-of-law principles.
Any arbitration agreement, venue selection, class-action waiver, or other dispute-resolution provision will apply only to the extent enforceable under applicable law.
